Project Clean Slate 2024

If you have a criminal record, Michigan's Clean Slate laws allow you to set aside eligible convictions! This process is commonly referred to as "expungement."

There are several steps and paperwork involved in the expungement process, but we're committed to helping individuals every step of the way. Through collaboration with community partners, we're able to offer free attorney, notary, and fingerprinting services.

Michigan's Clean Slate Initiative

In 2020, the State of Michigan passed “Clean Slate” legislation. These laws allow Michiganders to erase or expunge eligible criminal records. Clean Slate legislation went into effect on April 11, 2021. Visit the Attorney General's Expungement page for more information.

Expungement Process

There are several steps and paperwork involved in setting aside conviction records. Below is the general overview, but the process depends on your individual situation.

  1. Obtain certified copies of conviction records
  2. Complete application (Form MC 227, MC 227a, or MC 227b)
  3. Obtain fingerprints (RI-008 Fingerprint Card)
  4. Sign and notarize the application
  5. Make five copies of application and conviction records
  6. File application with the Clerk's office at the court of conviction and schedule your hearing date 
  7. Mail copies of application packet to the applicable prosecutor's office, the Michigan Attorney General, and the Michigan State Police
  8. With the remaining two application copies, complete proof of service
  9. Prepare for your hearing

Excluded Offenses

Life offenses and certain criminal sexual conduct convictions are ineligible to be removed under the Michigan Clean Slate law. Traffic convictions under a commercial driver’s license and traffic convictions involving injury and/or death are ineligible for removal from your record. Out-of-state or federal convictions are ineligible for this program.

Eligible Offenses

Clean Slate laws allow for unlimited misdemeanors and up to three felonies to be set aside during a person's lifetime. A fourth felony categorically bars an individual from expunging ANY conviction.

Please note that eligibility determinations can only be made after reviewing an applicant's criminal history report (ICHAT). Individuals seeking expungement are encouraged to apply using the link above.

Waiting Periods

  • More than one felony - 7 years
  • One felony or one or more "serious misdemeanors" - 5 years
  • One or more "regular" misdemeanors - 3 years

When does the waiting period begin?

The latest of the following events:

  • The date the applicant was sentenced
  • The date the applicant completed probation
  • The date the applicant was discharged from parole
  • The date released from incarceration

Automatic Ineligibility

If an applicant has any of the following, they are automatically ineligible for expungement:

  • Four or more felony convictions (one bad night provision may apply)
  • Pending criminal charges
  • Active arrest warrants
  • Currently on probation or parole
