Program Period: The John Deere Chief Tractor Officer Search (the “Program”) begins 10:00 a.m. Eastern Time (“ET”) on April 16, 2024 and ends at 11:59 p.m. ET on April 29, 2024 (the “Program Period”).
Eligibility: Open to legal residents of the 48 contiguous United States and the District of Columbia, who are 18 years of age or older as of date of entry, and have/post to a public Instagram and TikTok account. For purposes of the Program and these Official Rules, the person submitting the Entry (as defined below) is considered the “Entrant” and his/her entry is deemed the “Entry”. Employees of Deere & Company (“Sponsor”), Don Jagoda Associates, Inc. (“Administrator”), Mindshare USA, LLC, The Goat Agency, their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively “Sponsor and its Administrators”), and each of their respective employees, directors, officers, members and agents and their immediate family members spouses, parents, children, and siblings and their spouses) and/or those living in the same household of each are not eligible to participate or win. Void in Alaska, Hawaii, and where prohibited by law and subject to all federal, state, and local laws.
How To Enter: To enter, you must visit www.JohnDeereCTO.com (the “Site”) and complete the registration, including uploading a video describing why you should be selected as the John Deere Chief Tractor Officer and providing the link to your public Instagram and TikTok profiles (collectively, “Submission”). Video must be 60 seconds or less. There is a limit of one (1) Submission per Entrant for the entire Program Period. Submissions must be in English. By entering, you understand that your Submission in its entirety or portion thereof may (in Sponsor’s sole discretion) be posted on websites, Social Media sites and/or other Sponsor-selected media. All online Submissions must be completed and submitted by 11:59 p.m. ET on April 29, 2024. Normal data/Internet access and usage charges imposed by Entrants’ online/phone service will apply.
Submission Requirements: To be entered into the Program, Entrants must comply with registration instructions when submitting their Submission. The Submission may not contain obscene, profane, lewd, defamatory or inappropriate images or text including no nudity, acts of violence or acts that appear to cause harm or are illegal/dangerous, as determined at Sponsor’s sole discretion. Any Submission or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, highlights brand in a negative way, contains any third party materials (other than Sponsor-owned), or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including, but not limited to, rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entrants may include the name of the company they work for in their Submissions, if applicable. Entrants may not copy or otherwise plagiarize the Submission from any source. If submitting a video depicting other individuals, you must make the other individuals aware that you are entering a video and attest that the other individuals have agreed that you may submit such video and you must be the parent/legal guardian of any minors featured in the video. If video features additional people, they (or you on behalf of your child/charge) may be required to sign a Release Form, in Sponsor’s sole discretion. Sponsor has the sole discretion to determine whether a Submission qualifies. All Submissions must be the sole, original work of the Entrants. By submitting a Submission, you hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, designees and legal representatives the irrevocable, perpetual, worldwide digital and other rights to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Submissions or excerpts of Submissions (as such may be edited and modified by the Sponsor at its discretion) for editorial, commercial, promotional and all other purposes (including posting on Sponsor-affiliated websites, Social Media sites and/or other Sponsor-selected media). In addition, you hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Submission. You further agree to waive any moral rights in and to the Submission. Automated, script, macro, AI-generated, or robotic Submissions submitted by individuals or organizations will be disqualified. If, at Sponsor’s sole discretion, the Submission appears to have resulted in any injury or bodily harm, it will be rejected. Any Submission not in compliance with the above and does not meet the Site’s requirements will be disqualified. Instagram/TikTok are not affiliated with this Program in any way and are not responsible for the administration of the Program or the awarding of the prize. No endorsement or approval of the Program by Instagram/TikTok is expressed or implied.
Finalists, Judging and Finalist Notification: All Submissions will be judged by Sponsor-selected judges (“Judges”) on or about May 17, 2024 based on the following criteria: Originality (30%); Creativity (25%); Video Quality and Aesthetic (25%); and Brand Knowledge (20%) (the “Judging Criteria”), to determine five (5) Finalists, subject to verification. Any tied Submissions will be re-judged by the judges based 100% on Originality to determine the Finalist(s). Finalists will be notified via email and will required to sign and return a Declaration of Eligibility and Liability Release, and except where prohibited, publicity release and assignment of rights (“Declaration”) within forty-eight (48) hours of notification in order to be confirmed as a Finalist. If Entrant fails to return the completed Declaration within forty-eight (48) hours, Declaration is returned as undeliverable, Entrant shall be deemed to be ineligible, the Finalist Prize will be forfeited and an alternate potential Finalist will be determined, time permitting. Declaration will be sent to the Entrant via email. Return of Finalist notification as undeliverable may result in disqualification and alternate determination, time permitting. Finalists will also be required to participate in a mandatory video chat interview with Sponsor (“Interview”) or an alternate Finalist will be determined. Sponsor will determine date/time and duration of Interview. Finalists will then be re-judged based 25% on the Interview and 75% on the Judging Criteria to determine one (1) Grand Prize winner. Any tied Finalists will be re-judged by the judges based 100% on the Interview to determine the Grand Prize winner. In the event Interviews cannot take place, the Grand Prize winner will be determined from the Finalists based solely on the Judging Criteria. Judges’ decisions are final with respect to all matters relating to the Contest. By participating, Entrants agree to the Official Rules and the decisions of the Judges, which shall be final and binding in all respects.
Prizes and Approximate Retail Value (“ARV”):
Grand Prize (1): The opportunity for winner to be named the “John Deere Chief Tractor Officer” by creating Content (“Content”) and submitting to Sponsor to use on platforms that may include, but are not limited to, Sponsor’s social media channels, or Sponsor-selected websites, etc. from the time Grand Prize winner is confirmed through approximately December 31, 2024 (“Tasks”). Grand Prize winner may also be required to post Content on their own social platforms, in Sponsor’s sole discretion. Grand Prize winner will receive up to $192,300, paid out in increments upon completion of each Task from the time Grand Prize winner is confirmed through approximately December 31, 2024. The Grand Prize winner will be required to make approximately forty (40) social media video posts. If the Grand Prize winner does not complete Tasks/create Content, they will not receive any payment(s). The details of the Grand Prize including details of Tasks, the cadence and timing of payments, payment processing, tax reporting, social media post contracts/requirements, etc. will be determined and managed by The Goat Agency on Sponsor’s behalf. See Rule #7 below for additional details.
All federal, state and local taxes on the total value of the prize are the sole responsibility of winner. Prize is awarded “as is” without any warranty or guaranty of any kind. Prize is not transferable. Prize will be awarded provided at least one (1) eligible Submission is received.
Finalist Prize (5 total): A Sponsor-selected prize package (ARV: $200 each).
Grand Prize Rules/Requirements:
Sponsor reserves the right to provide Grand Prize winner with details of specific Content they wish for Grand Prize winner to capture.
Grand Prize winner will be required to create approximately 40 videos from the time Grand Prize winner is confirmed through approximately December 31, 2024 (approximately 6 videos per month) to be posted on the John Deere Brand TikTok Page.
Video editing will be managed by The Goat Agency on behalf of Sponsor, but Grand Prize winner will be required to complete the majority of the video editing.
Grand Prize winner will be required to participate in regularly scheduled meetings to discuss Content creation, Content feedback, and posting cadence and all scheduling is in Sponsor’s/The Goat Agency’s sole discretion.
Grand Prize winner will be required to plan Content ideas every two (2) weeks, which may include, but is not limited to, light story board and key word scripting (as needed). Grand Prize winner will be tasked with creating authentic Content, but will be required to abide by a Content brief in alignment with Sponsor’s do’s and don’ts, FTC laws, etc.
Grand Prize winner agrees that Sponsor will retain full usage of all Content created by Grand Prize winner indefinitely (“Grand Prize Footage”). Sponsor may use this Grand Prize Footage, or excerpts of the Grand Prize Footage, in any way it sees fit, including posting on any of their social media sites/websites and potentially other mediums, in perpetuity.
Grand Prize winner understands and agrees that, as a condition of being awarded the prize, he/she may be subject to a background check at the sole discretion of Sponsor; failure to comply may result in disqualification and forfeiture of prize. In addition, at the discretion of the Sponsor, potential Grand Prize winner may be disqualified if the background check reveals: (a) potential Grand Prize winner was charged with or convicted of a felony or misdemeanor; (b) potential Grand Prize winner engaged in conduct, in Sponsor’s sole discretion, that could damage the reputation or reflect unfavorably on the Program or Sponsor; (c) potential Grand Prize winner is not eligible to receive the prize based on the eligibility requirements set forth in these Official Rules; (d) that potential Grand Prize winner failed to comply with these Official Rules in any way; or (e) if potential Grand Prize winner refuses to or cannot accept the prize for any reason. Potential Grand Prize winner social media profiles must be in keeping with the Sponsor’s image or they may be disqualified, in Sponsor’s sole discretion.
Grand Prize winner will be required to travel up to 10 times through November 2024. Travel expenses, including air transportation and hotel accommodations, will be covered by Sponsor for Grand Prize winner only (no guests).
All bookings and accommodations will be managed by The Goat Agency. Airline carrier's regulations and conditions apply. Trip(s) may not be combined with any other offer and travel may not qualify for frequent flyer miles. Grand Prize winner must possess valid travel documents (i.e., REAL ID, passport or other TSA-approved ID; visit www.tsa.gov for a list of TSA-approved IDs) in order to travel. Seat selection and timing of trip(s) subject to availability and confirmation of reservations. In the event the Grand Prize winner lives within one-hundred fifty (150) miles of a destination, round-trip ground transportation may be provided in lieu of air transportation. Certain restrictions may apply. Travel must be taken on date(s) specified by Sponsor or the opportunity to participate in that Task will be forfeited and no compensation for that Task will be provided. All travel must be round trip. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. No refunds or credit for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, meals, ground transportation, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges, personal charges at lodging, security fees, entertainment and transfers, are Grand Prize winner’s sole responsibility. Grand Prize winner must follow any applicable COVID protocols in place at time of travel. Grand Prize winner agrees that Sponsor or its agents may photograph and/or videotape any or all aspects of travel (“Travel Footage”) and Grand Prize winner agrees that Sponsor may use or edit that Travel Footage in any way they see fit.
Grand Prize winner may need to execute additional documents required by Sponsor or any of its agencies, in Sponsor’s sole discretion.
General Rules: Potential Grand Prize winner will be required to sign and return a Grand Prize Acceptance Form (“Form”) within forty-eight (48) hours of notification in order to be confirmed as the Grand Prize winner. If Entrant fails to return the completed Form within forty-eight (48) hours, Form is returned as undeliverable, Entrant shall be deemed to be ineligible, the Prize will be forfeited and an alternate potential Grand Prize winner will be determined, time permitting. Form will be sent to the potential Grand Prize winner via email. Return of prize notification as undeliverable may result in disqualification and alternate determination, time permitting. Grand Prize winner, Finalists and all Entrants, as a condition of entry into the Program, agree to release Sponsor and its Administrators, each of their respective agencies, parents, subsidiaries, affiliated companies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Program (collectively the “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with creation of or submitting a Submission or otherwise participating in any aspect of the Program, the receipt, ownership or use of prize (including Content creation and Tasks) awarded or any typographical or other error in these Official Rules or the announcement or offering of the prizes. Acceptance of a prize constitutes permission to use Grand Prize winner’s/Finalists’ names, likenesses, Interviews and Submissions, Grand Prize Footage/Content/Travel Footage for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By participating in the Program, Entrants/Grand Prize winner/Finalists agree to be bound by these Official Rules and the decisions of the Judges. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Program or by any human error which may occur in the processing of the Submissions/Content/Tasks in the Program or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Program. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry/prize process or the operation of the Program; violates these Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Program may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the email address used to enter will be deemed to be the Entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If, for any reason, the Program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, then the Sponsor reserves the right at its sole discretion to cancel the Program and determine the Finalists from among all eligible Submissions received prior to cancellation, based on the Judging Criteria listed above. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. You hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents. Submissions generated by script, bot, or AI are not eligible. As a condition of entering the Program, Entrant/Grand Prize winner/Finalists agrees that: 1) under no circumstance will Entrant/Grand Prize winner/Finalists be permitted to obtain awards for, and Entrant/Grand Prize winner/Finalists hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Program, or the prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees.
Conditions: Grand Prize winner/Finalists acknowledges and agrees that Sponsor has the right to edit, adapt, modify, reproduce, promote and otherwise use the Submission/Grand Prize Footage/Content/Travel Footage (as applicable) in any way it sees fit in connection with advertising in any medium, throughout the world, in perpetuity. Entrant/Grand Prize winner/Finalists shall have no right to review or approve edits, alterations or modifications, and the Entrant/Grand Prize winner/Finalists waive the benefit of any provision of law known as “moral rights.” No information regarding Submissions or judging will be disclosed to any third party not involved in the conduct of the Program. By submitting a Submission, you represent: (a) that the Submission is your own original work that has not previously been published or publicly shown or won a prize or award; and (b) any and all rights to the Submission belong to you and the Submission does not infringe, misappropriate or violate the rights of any third party. Further, any Submissions that Sponsor, in its sole discretion, deems to be inappropriate for publication will not be considered.
Privacy: Information collected from Entrants is subject to Administrator’s Privacy Policy, located at https://dja.com/privacy-policy. When the personal information is transferred to the Sponsor, the Sponsor’s Privacy Policy applies, located at https://www.deere.com/en/privacy-and-data/.
Winners List: For the names of the winner and Finalists (“Winners List”), available for ninety (90) days after May 1, 2024, send an email to: Winners@dja.com with “John Deere Chief Tractor Officer Search” as the subject line. Winners List will be sent after the prizes have been awarded.
