Application for a Hand Weeding Variance Certificate
 Pursuant to §§ 8-13.5-203(2)(d) and (e), C.R.S.,  the Colorado Department of Agriculture has established this application for an Agriculture employer to seek a variance certificate to allow for more than the "occasional and intermittent hand weeding (defined in statute as greater than 20% of a worker's weekly work time).  

The variance certificate applies to an agriculture employer who either is seeking organic certification within a three year period or an agricultural employer that is able to establish:
1) The hand weeding does not require prolonged and unnecessary stooping, kneeling, or squatting and does not create a risk of acute, chronic, or debilitating injuries, and
2) There is no suitable long-handled tool or other alternative means of performing the work that is suitable and appropriate to both the production of a commodity and the scale of the operation,
3) The agricultural employer does not qualify for specific statutory exemptions. (See summary of exemptions WEBSITE)

The following application must be filled out by an authorized person for the agricultural employer. Once completed, the CDA staff will review.  Once approved a certificate will be emailed/mailed to the employer.
